DISCLAIMER AND LICENSE AGREEMENT

All subsequent uses of the term WinFlash refer generically to the WinFlash Basic, WinFlash Scholar and WinFlash Educator programs.

Users of WinFlash accept this disclaimer of warranty:

WinFlash is supplied as is. The author disclaims all warranties, expressed or implied, including, without limitation, the warranties of merchantability and of fitness for any purpose. The author assumes no liability for damages, direct or consequential, which may result from the use of WinFlash.

WinFlash is a shareware program and is provided at no charge to the user for evaluation. Feel free to share it with your friends, but please give them the original setup file (FLASH32.EXE for Basic; FLASHSC.EXE for Scholar; FLASE.EXE for Educator) so that they will have all of the necessary support files and the benefit of automated program installation. If you find this program useful and wish to continue to use WinFlash after the trial period (30 days or 30 uses, whichever is LONGER), you must purchase a licensed copy (Basic - $19.95; Scholar - $29.95; Educator - $39.95) (plus S) from Open Window Software.

For individuals ONLY, the licensed copy can be used on any one computer at any one time. You must treat this software just like a book. For individuals this software may be freely installed on multiple computers belonging to the individual, so long as there is no possibility of it being used at one location while it's being used at another - just as a book cannot be read by two different persons at the same time.

For corporate, institutional or government use, the license fee covers a single, non-server, machine per license only. Open Window Software offers a generous discount on multiple-copy license packs. The shareware version of the program will not run from a server. Please order server-capable versions directly from Open Window Software.

While distribution of the intact shareware version is encouraged, users are prohibited from distributing licensed copies of the software. In addition, users may not modify the program's executable file in any way.

Please remember that it is illegal to give your unlock code to anyone else. Illegally obtained software is no less "stolen goods" than shoplifted merchandise from a department store.

Anyone distributing WinFlash for a fee of any kind must read the conditions in the PAD_FILE.XML file distributed with this application.

Important Note:

WinFlash includes .GIF graphics technology covered by the LZW patent licensed from Unisys Corp. IF YOU USE THE .GIF GRAPHICS CAPABILITIES OF WINFLASH, THE FOLLOWING ADDITIONAL LICENSE REQUIREMENTS PERTAIN:

1. The license allows the use of the software on only a single computer or workstation which is not used as a server.

2. The licensing of WINFLASH does not entitle the user to any other uses of LZW technology.
